Surrogacy

We’d love to hear from you…

Exploring the idea of having a baby through surrogacy?

At Aubrey Brown Lawyers we are constantly evolving as laws and trends change in Australia. Over recent years we have seen a rise in the number of people, wanting to start or grow a family though Surrogacy.

What is surrogacy?

A woman who carries an embryo to full term on behalf of another person/s (the intended parent/s) is called a Surrogate.

In Australia, Surrogacy is legal in all states, as long as there is no payment for the service (other than reimbursement for all reasonable expenses incurred during the pregnancy). This is known as Altruistic Surrogacy.

Surrogacy is heavily regulated by law In Australia

Each state and territory is responsible for its own Surrogacy legislation. But all have one thing in common – agreements between the intended parents and birth mother are not legally binding. That means the Surrogate mother has the legal right to change her mind and keep the baby at birth if she chooses to.

At Aubrey Brown Lawyers, we have the experience and knowledge to advise you on your rights, obligations and entitlements in relation to a Surrogacy arrangement in Australia, or using an overseas surrogate.
